What is BIS Certification?
The Bureau of Standards of India (BIS) is the national standards agency operating under the protection of the Indian Ministry of Consumer Affairs, the Ministry of Food and Distribution of Public Goods and the Government of India. It was established under the Indian Standards Act, which was enacted and implemented on 23 December 1986. The governing minister of the agency is the CHAIRMAN of the BIS and has administrative authority over the agency.
This organization predecessor was the Standards Institute of India (ISI), which was established on the basis of resolution No. 1 Std.(4)/45 made by the industry and supply sector (adopted on 3 September 1946). The ISI was also registered as early as 1860 when India introduced the Social Group Registration Act. As a corporate organization, its 25 members are drawn mainly from central or national governments, industry, research institutes and consumer organizations. The agency headquarter is in New Delhi and has regional offices in Kolkata, Chennai, Mumbai, Chandigarh, Delhi, etc. At the same time, it has 20 branches. It is also a India Information Office of the WTO 's Technical Barriers.
BIS certification is the BIS product certification scheme for certain products sold in India. It aims to provide consumers with third party assurance as to the level of quality, safety and reliability of products. Such certification is ensured by routine supervision of licenses, including surprise inspections and sample checks of products in markets and factories. Manufacturers can re-certify licensed products on the basis of ensuring compliance with the system. Through monitoring measures, the BUREAU of Indian Standards can maintain a close monitoring of the quality of certified goods.
The BIS product certification scheme is open to manufacturers from all countries without any discrimination. Any foreign or Indian business company is free to apply for BIS certification in accordance with the relevant certification and authorization procedures, which are as follows:
-- Indian manufacturers can apply for BIS accreditation through a simplified process that requires the manufacturer to provide a sample test report from an officially licensed laboratory, after that,The BIS staff will go to the factory of the application company for a field visit. If the test report is satisfactory and BIS standards are met, the license will be issued within 30 days of the site visit.
-- If Indian importers can maintain a fully equipped laboratory to conduct tests to BIS standards, they will be treated on a par with Indian manufacturers.
-- The process for granting BIS licenses to foreign manufacturers is a little more complicated, taking about 45 to 60 days.
BIS certification does not differ from country to country and is not required for all products. BIS certification is mandatory for imported products to be notified by DGFT (Note: for certified product, please see attached BIS Certified Products List).
In addition to the normal import and export declaration procedures, all goods requiring BIS certification must have a "self-declaration" printed on various specific goods and external packaging. A valid self-declaration must have a specified product registration number and India Standard (IS) number.
二、BIS certification of LED products
(一) BIS certification is mandatory for the following LED lighting products and components:
-- Self-ballasting LED lamps for general lighting services
-- Fixed universal LED lamp
-- DC or AC powered LED electronic control module
(二) Why choose BIS
In essence, the BIS marking scheme was born at the right moment. But while keeping a high focus on consumer interest, the central government has made it mandatory that products that are important for mass consumption, consumer safety and health and energy conservation comply with the BIS certification scheme. So far, 122 items have been included in the mandatory certification program. The certification mark on the product marks the relevant Indian standard for the commodity symbol.
Government Policy: The National Electronics Policy of India was established by the Government of India to promote the development of electronic systems and promote manufacturing to increase global market share, and LED products are included in this policy. The policy was drafted by the Ministry of Information Technology and the Ministry of Transport. It offers a unique opportunity for companies looking to India as a destination for investment in the ESDM sector and will help India become the next world's largest electronics manufacturing hub, providing value-added manufacturing products related to mid to high end technology to India. Therefore, mandatory BIS certification for certain electronic products is intended to prevent the flow of substandard or unsafe products into India through technical and security standards that are in line with international standards.
(三) BIS certification process
Foreign manufacturers who wish to obtain a BIS license need to submit a BIS application form and the associated application fee. Applications for products that apply to different standards should be submitted separately. To submit your application, you need to provide the following documents:
1. Verification documents for setting up a branch (i.e., setting up a branch in India if a foreign company needs to apply for BIS certification using its own brand); The Indian office of the applicant or his/her agent, e.g. certificate of incorporation of a corporation, partnership, etc.; Reserve Bank of India (RBI) approval is also provided when required.
2. The documents relating to the appointment of full representatives of the office or branch or legal representative of the applicant company shall be duly pasted on the letterhead in official form. A complete flow chart showing the production process (from the raw material or parts purchase stage to the production completion stage).
3. Factory operation complies with the requirements of quality control system (e.g., quality manual, quality plan, test requirements, etc.).
4. Other certification details for the product or system at the factory, if available.
5. Pre-certification of components or raw materials used in the production process, if available.
6. List of machines used in the production process.
7. Test equipment list.
8. Pictures of products and components,if available.
9. Appointment letter, qualification certificate and details of experience of laboratory leader, technical personnel and quality control personnel (excluding consultants).
10. Test reports from independent, reputable laboratories or internal laboratories of the applicant company.
11. Factory layout diagram with clear location of major production equipment and laboratories.
12. A map showing the location of the factory to the nearest airport, railway station, landmarks and how to get there from India.
13. A sight draft in Indian rupees (tax included) for the relevant charges, or the equivalent in US dollars accepted by the Bureau of Indian Standards and payable in New Delhi.
14. Details of previously held licences, cancelled licences and applications rejected. The reasons, if any, for the cancellation of a licence or the rejection of an application in the past should be stated in the application form if there is any offence under the BIS Act 1986.
15. The foreign manufacturer shall open an office or branch in India with the permission of the Reserve Bank of India and may also appoint a legal representative or establish a subsidiary in India to reflect its agreement to comply with the BIS Act 1986.
16. The application submitted by the applicant to BIS will be examined in detail. After recording the application, the BIS examiner or their agent will conduct a preliminary survey of the applicant's manufacturing and testing addresses. The initial validity of the license is one year. If the operation is good, the license will be renewed for one to two years.
(四) The consequences of violating the treaty
If the compulsory registration of imported goods does not have a certification mark, it cannot be reported to the customs.
If the product is manufactured in India and sold in the Indian market but not registered with BIS, it will be destroyed or confiscated by the Indian government.
